Disclosure of personal information under RTI Act-2005-DOPT Clarification

Dear Comrades,
DOPT vide its order dated 14/08/2013 it is clarified the disclosure of the personal information in view of the Supreme court order. As per the order ""The performance of an employee/Officer in an organisation is primarily a matter between the employee and the employer and normally those aspects are governed by the service rules which fall under the expression 'personal information', the disclosure of which has no relationship to any public activity or public interest. On the other hand, the disclosure of which could cause unwarranted invasion of the privacy of that individual.". The Supreme Court further held that such information could be disclosed only if it would serve a larger public interest.

Now, all Central ministries to accept online RTI pleas from today

Filing online RTI applications in all central ministries and departments through a common web-based platform will become a reality from Wednesday. At present, this facility is available only for 40 ministries, departments and commissions. 

Now, the government will extend this facility to all central institutions, including ministries, departments and commissions, which are covered under the Right to Information (RTI) Act, 2005. 

"The minister of state for personnel, V Narayanasamy, will formally launch this facility here on Wednesday", said an official. 

The government had launched an exclusive portal, https://rtionline.gov.in, for this purpose earlier this year, initiating this facility only for the questions asked from the ministry of personnel. This facility was subsequently extended to other ministries, including home, health, external affairs and agriculture, President Secretariat, Union Public Service Commission (UPSC) and Vice-President's Office. 

"The portal will now be open to entertain questions under the RTI Act for all the remaining ministries from August 21. The entire website is prepared in such a way that the system would provide online reply to all RTI applications," said the official. 

This portal — developed by NIC — is a facility for Indian citizens to file online RTI applications and first appeals and also to make online payment of RTI fees. 

A department of personnel and training (DoPT) note said, "The prescribed fees can be paid through Internet banking of State Bank of India and its associate banks as well as by credit or debit cards of Visa or Master, through the payment gateway of SBI linked to this site". 

The RTI Act mandates timely response (within 30 days) to citizens' requests for government information. An information-seeker has to pay a fee of Rs 10 for getting the information. 

Giving details of the guidelines for information-seeker, the department said that the text of the application that can be uploaded at the prescribed column (on the website) was limited to 500 words only. "In case, an application exceeds more than 500 words, then it can be uploaded as an attachment," it said. 

If additional fee is required, covering the cost for providing information, the CPIO will intimate the applicant about the same through the portal. The first appeals filed through the website will also reach electronically to the nodal officer of the DoPT who would transmit the appeals to the First Appellate Authority (FAA). 

"Though optional, the mobile number can be provided by the applicant/appellant in order to receive SMS alerts. On submission of an application, a unique registration number will be issued, which may be referred by the applicant for any future reference," said the department's guidelines. 

Under the existing guidelines, no RTI fee is required to be paid by any citizen who is below poverty line as per RTI Rules, 2012.

Extension of RTI web poral to filing of RTI applications -DOPT Orders

Dear comrades,
DOPT vide its OM dated 12/08/2013 it is intimated that now the facility of filing RTI applications through web portal is now extended to all Ministries/Departments of Governent of India w.e.f 21/08/2013. This facility is presently not proposed to be extended for field offices/attached/subordinate offices.Now All the citizens can avail the service.

The officials in  Part-II  may exercise option for pay fixation under the provisions of FR-22 (I) (a)(1) if they are not in the Pay band of Rs.5,200/--20,200/- with Grade Pay of Rs.2,800/- and Rs.9300-34,800 drawing in the grade pay of Rs.4,200/-   within one month from the date of assuming charge in the promotional post. 

 The officials should accept/decline the promotion unconditionally in writing within one month from the date of issuance of this order. 

In case the official declines promotion, an unconditional declination letter may please be obtained  immediately and to be forwarded to this office for taking further necessary action.   If

declines promotion , they should note that they are not eligible for promotion to the cadre of Norm based LSG (Postal) for a period of 1 (one) year either on regular or adhoc basis from the date of declination.  Further the officials who decline promotion will not be considered for financial upgradation under MACP Scheme, if any due, as per the existing rules/instructions till they accept promotion.

The Divisional Superintendents concerned should relieve the officials forthworth with a direction to join them in the promotional post immediately.

No request for re-allotment will be registered before joining in the new post allotted.

Circle Council Meeting has been Inaugurated by Com.K.V.Sreedharan

Dear comrades,
Circle Council meeting has been Presided over by Sri K.Narayan Rao, Circle President and inaugurated by Com.K.V.Sreedharan, Former General secretary, AIPEU Group-C, New Delhi and Staff side leader of JCM (Departmental Council). Com.M.Krishnan has also presided over the meeting. Com.K.V.Sreedharan in his presentation elaborately explained about the Staff Rules on the service matters through power point presentation. In the afternoon session Sri Someshwar Rao, Retd.SSRM, has explained about the CCS (Conduct) Rules 1964. Finally Com.M.Krishnan has explained about the latest developments going to be taken place in the Postal Department in near future and role of the trade union. A brief interaction Com.M.Krishnan with the participants also clarified all the doubts.

Today Youth Convention Inaugurated by Com.S.Veeraiah

As Scheduled today Youth Convention has been inaugurated by Com.Veeraiah, Former General Secretary, CITU A.P.State Committee.Com.Veeraiah in his inaugural speech explained about the present financial situation of the country and the role of Trade Union.Com.M.Krishnan explained the History of Indian Postal Trade Union Movement and the need of active participation of younger generation.A small interaction session has conducted with the newly recruited PAs/SAs. In that session Com.Krishnan has clarified the doubts of them.Com.K.V.Sreedharan has explained about the impact of PFRDA bill which is pending in the parliament and disadvantages of NPS. Com.Krishnan also explained the latest position of various pending sectional issues with the department.On behalf of Federation Com.Krishnan congratulated the initiative taken by the Circle Union to educate the newly recruited PAs/SAs.

JCM Standing Committee (Departmental) Meeting going to be held on 23/08/2013


UOI SLP against Pre-2006 Pensioners dismissed by Supreme Court.



The Supreme Court has dismissed the SLP (Civil) 23055/2013 filed by Union of India against Delhi High Court judgement in pre-2006 pensioners casein WP 1535/2012 upholding the CAT PB judgement and Delhi High Court judgement. The above SLP came up for hearing on 29/7/2013 and the apex court dismissed the SLP on the same day.

Pensioners will now get arrears w.e.f. 1/1/2006 if their revised pension was fixed at less than 50% percent of the minimum of the pay in the pay band including grade pay thereon in the revised scale corresponding  to the pre-revised pay scale from which the pensioner has retired.

JUDGEMENT :
UPON hearing counsel the Court made the following order :
“We are not inclined to interfere with the order passed by the High Court. Consequently, the special leave petitions are dismissed. However, the
