Merger of TSOs-Unilateral decision taken by Heads Of Circles

Dear Comrades,
The unilateral Decision of merger of TSOs taken by Heads Of Circles Meeting held during second week of April 2010 at Ghaziabad.CPMG disclosed the decision in a meeting with Circle secretary.I requested CPMG to give the same in writing we will discuss and intimate our response.Accordingly CPMG,A.P.Circle addressed all the Circle Secretaries. The letter addressed to me is placed here for the information of the menbers and I request all the Divisional/Branch Secretaries to send their views either in writing or through email to Circle union.The issue will be discussed in the CWC and decision taken by circle union will be intimated very shortly. The issue has been brought to the notice of Federation and Central Head Quarters also.

RE-VERIFICATION PROCESS NEARING COMPLETION - SUBMIT MEMBERSHIP DECLARATION FORMS BEFORE 26/04/2010

Re-verification of Membership Process is nearing completion and all the Membership Declaration Forms obtained from our members are to be submitted to the Divisional Heads before 26.04.2010.
All Divisional and Branch Secretaries are requested to be alert and submit the Membership Declaration forms along with 5 list of Members signed duly at the bottom of each page by the Divisional / Branch Secretaries at the earliest before 26th April 2010.
No need to wait till the last hour - Submit all the collected Declarations as early as possible, even one or two days well in advance - Any left out membership declartion forms can be collected and separately submitted before 26th April.


BE ALERT - BE VIGILANT - BE QUICK - COMPLETE THE TASK IMMEDIATELY - ENSURE THE STATUS OF NFPE UNIONS

Draft of Indian Post Office (Amendment) Bill 2006

Dear Comrades,

Central Government was proposed to amend Indian Post Office Act 1898. In this connection the Government was introduced the bill in parliment in the year 2006 and it is not yet passed. The bill in in intrductory stage only. The draft of the bill is placed here for the information of the members. Please go through the bill carefully. The main intention of the bill is to privatise the postal services and establish Mail Regulatory Development Authority to monitor Postal Services and to establish Mail Disputes Tribunal to settle the grevances of the customers. The monoploy over postal articles weighing up to 300 gms lies with Postal Department. Totally the bill is harmfull to the workers of the entire Postal Department.

Amendmnt to Rule 64,71,72&80 of CCS (Pension) Rules 1972

Dear Comrades,

DOPT issued OM No.20/16/1998-P&PW(F) dated 19/04/2010 regarding amendment to Rule 64,71,72&80 of CCS (Pension) Rules, 1972.The following amendments have been taken place.
1.In the CCS (Pension) Rules 1972, in Rule64, in sub rule (4"), in clause (a) in sub-clause (ii) for the words "ten per cent of gratuity or one thousand rupees, whichever is less" the words "ten per cent of gratuity" shall be substituted.
2.In rule 71 of the said rules, in sub-rule (3), in clause (a) after he words "licence fee" the following shall be inserted namely
"as well as damages (for the occupation of the Government accommodation beyond the permissible period after the date of retirement of allottee)"
3.4. In rule 72 ofthe said rules,-(a) in sub-rule (5), for the word's"ten per cent of gratuity or one thousand rupees,whichever is less", the words "ten per cent of gratuity" shall be substituted.
(b) for sub-rule (6), the following sub-rules shall be substituted, namely :--
 "(6) The recovery of licence fee (where it is not possible for the Directorate of Estates to detennine the outstanding licence fee) as well as damages (for the occupation of the Government accommodation beyond the permissible period after the date of retirement of allottee) shall be the respondibility of the Directorate of Estates and the withheld amount of gratuity under sub-rule (5) above, the retiring Government employees who are in occupation of Government accomodation, shaH be paid immediately on production of. "No Demand Certificate "fromth~Directorate of Estates after actual vacation of the Government accommodation;
(7) The Directorate of Estates shall ensure that "No Demand Certificate" shall be given to the Government employee within a period of fourteen days from the actual date of vacation of the Government accommodation and the allottee shall be entitled to payment of interest (at the rate applicable to General
Provident Fund deposit detennined fromtime to time by the Government oflndia) on the excess withheld amount of gratuity which is required to be refunded, after adjusting the arrears of licence fee and damages, if any, payable by the allottee and the,interest shall be payable by the Directorate of Estates through the concerned Accounts Officer of the Government employee from the actual date of vacation of the Government accommodation up to the date of refund of excess withheld amount of gratuity;
(8) On account of licence fee or damages remaining unpaid after adjustment from the withheld amount of gratuity mentioned under sub-rule (5) above, may be ordered to be recovered by the Directorate of Estates
through the concerned Accounts Officer from the Dearness Reliefwithoutthe consent of the pensioners and in such cases no Dearness Reliefshall be disbursed until full recovery of such dues has been made.
5. In rule 80 ofthe said rule, in sub-rule (4), in clause (c), for the words "ten per cent of the amount of gratuity or rupees one thousand, whichever is less", the words "ten per cent of the amount of gratuity" shall be substituted.
6. In rule 80-C of the said rules, in sub-rule (I), in clause (v), for the words "ten per cent of the death gratuity
or one thousand rupees, whichever is less", the words "ten per cent of death gratuitY" shall be substituted.

Amendment to Rule 11-Clause(vi) of CCS (CCA) Rules 1965

Dear Comrades,
DOPT issued an amendment to Clause vi of Rule 11 of CCS (CCA) Rules 1965 vide GSR 55(E) dated 02/02/2010.In the Central Civil Services (Classification,Control and Appeal) Rules, 1965, in rule I I, for clause (vi),the following clause shall he substituted, namely :-

"(vi) reduction to lower time-scale of pay. grade, post or Service for a period to be specified in the order of
penalty, which shall be a bar to the promotion of the Government servant during such specified period to
the time-scale of pay, grade, post or Service from which he was reduced, with direction as to whether
or not, on promotion on the expiry of the said specified period-

(a) the period of reduction to time-scale of pay,grade, post or service shall operate to postpone future increments of his pay, and if so, to what
(b) the Government servant shall regain his original seniority in the higher time scale of pay, grade, post or service;"

Below Benchmark gradings in ACRs prior to the reporting period 2008-09 and objective consideration of representation by the competent authority against remarks in the APAR or for upgadation of the final grading

Dear Comrades,
DOPT issued a clarification on the above subject vide Memo No.21011/1/2010-Estt.A dated 13/04/2010.
The question of treating the grading in the ACR which is below the benchmark for next Dromotion has been considered in this De~arbnenat nd it has been decided that if an employee is to be considered for promotion in a future DPC and his ACRs prior to the period 2008 09 which would be reckonable for assessment of his fitness in such future DEcSont ain final grading which are below the benchmark for his next promotion, before such ACRs are placed before the DPC,the concemed employee will be given a copy of the relevant ACR for his representation, if any, within 15 days of such communication. It may be noted that only below benchmark ACR for the period relevant to promotion need be sent. There is no need to send below benchmark ACRs of other years As per existing instructions, representations against the remarks or for upgradation of !he final grading given in the APAR (previously known as ACR) should be examined by the competent authority in consultation, if necessary, with the Reporting and the Reviewing Officer, if any. While considering the representation, the competent authority decides the matter objectively in a quasi-judicial manner on the basis of material placed before it. This would imply that the competent authority shall take into account the contentions of the officer who has represented against the particular remarkslgrading in the APAR and the views of the Reporting and Reviewing officer if they are still in service on the points raised in the remesentation vis-a-vis the remarkstaradinas given bv them in the APAR. The UPSC has informed this
 Departrnent that the Commission hasobsebei that while deciding such representations,t he competent authorities sometimes do not take into account the views of RewrtinaIReviewina Officers if thev are still
in service. The Commission has further observed that in a'majGty of succ cases, the competent authority does not give specific reasons for upgrading the below benchmark ACRlAPAR gradings at par with the benchmark for next promotion.

Move to Suspend Trade Union Laws-AITUC General Secretary Sri Gurudas Dasgupta

Dear Comrades,
AITUC General Secretary Sri Grudas Dasgupta on Saturday alleged that the Centre was planning to suspend trade union laws in key industrial zones across the country after notifying them as national economic zones.Addressing a press conference at Hyderabad the senior trade union leader said it was a move being contemplated against the workers rights. As it is, the violation of trade union laws was notoriously high in the country, more so in the unorganised sector he stated.The government had also failed to set up regional welfare boards promised for the welfare of unorganised sector workers. All major trade unions, including INTUC, AITUC, CITU, HMS and others, had come together for the first time in 30 years in New Delhi recently under the chairmanship of INTUC president Sri G.Sanjeevareddy and had decided to fight against price rise.

Rates of DA applicable w.e.f 01/01/2010 to employees of C.G and C.A Bodies continuing to draw their pay in the pre-revised scale as per 5th CPC

Dear comrades,
Ministry of Finance issued DA orders vide their Memo No.1(3)/2008-EII(B) dated 31/03/2010 for the employees of central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised scale of 5th CPC. According to this order the DA of the above employees has been enhanced from the existing rate of 73% to 87% w.e.f 01/01/2010.
